3. Description of Services

ODSI provides the following services:

  • Maintain and curate a directory of African open source projects
  • Facilitate project submissions and listings
  • Provide educational resources on digital sovereignty
  • Advocate for open source policies in Africa
  • Connect developers, policymakers, and institutions

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice.

By submitting a project to our directory:

  • You grant ODSI a non-exclusive, royalty-free license to display and promote the project
  • You acknowledge that projects are subject to review before publication
  • You accept that ODSI may reject or remove projects at its discretion
  • You confirm the project aligns with open source principles

All approved project information becomes publicly visible on our directory.

6. Intellectual Property Rights

ODSI Content:

All content on our Website, including text, graphics, logos, images, and software, is owned by or licensed to ODSI and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

User-Submitted Content:

You retain all intellectual property rights to the projects you submit. By submitting a project, you grant ODSI a non-exclusive, worldwide license to display, promote, and distribute information about your project through our Services.

Open Source Licenses:

Projects listed in our directory are governed by their respective open source licenses. ODSI does not claim ownership over submitted projects or alter their licensing terms.

7. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

We use GoatCounter, an open source, privacy-first analytics platform that respects user privacy and minimizes data collection.

  • THE QUALITY OF ANY LISTED PROJECTS MEETS YOUR EXPECTATIONS

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ODSI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES

11. Indemnification

These Terms and Conditions shall be governed by and construed in accordance with the laws of The Gambia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms and Conditions or your use of our Services shall be subject to the exclusive jurisdiction of the courts located in The Gambia.

14. Changes to Terms

We reserve the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using our Services.

15. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and ODSI regarding our Services and supersede all prior agreements, communications, and understandings, whether written or oral.
